Welcome to Pergola Crew Collective.
These Terms of Service (“Terms”) govern your access to and use of the Pergola Crew Collective website, Skill Bridge, Beacon ABA, and any related applications, features, materials, communications, trials, and services we provide collectively, the “Services.” In these Terms, “Pergola Crew Collective,” “we,” “our,” and “us” refer to Pergola Crew Collective and its owners and operators. By accessing, registering for, purchasing, or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not access or use the Services.
1. Eligibility and Authority
You must be at least 18 years old and legally capable of entering into a binding agreement to create an account or purchase the Services.
By using the Services, you represent that:

You are authorized to use the email address and account information submitted.

If you use the Services for a school, clinic, business, employer, or other organization, you are authorized to accept these Terms on its behalf.

You will comply with these Terms, applicable laws, professional requirements, and organizational policies.
The Services are intended to be operated by adults, including parents, guardians, educators, therapists, behavior analysts, technicians, clinical personnel, and other authorized professionals. Children and clients may participate in activities created through the Services under appropriate adult supervision, but they may not independently create or manage an account unless expressly permitted by us.
2. Description of the Services
Pergola Crew Collective develops educational, visual-support, organizational, and ABA-related tools.
Skill Bridge
Skill Bridge may include tools such as:

Beacon ABA may include tools such as:

Administrative workflows

Training and curriculum tools

Data organization

Other features designed for ABA professionals and organizations
Features may be changed, added, removed, suspended, limited, or discontinued at any time. We do not guarantee that every announced, previewed, trial, or “coming soon” feature will be released.
3. Educational and Administrative Tools Only
The Services provide educational, organizational, documentation, and administrative support. Pergola Crew Collective does not independently provide through the software:

Medical care

Psychological treatment

Mental-health services

ABA therapy
-
Clinical supervision

Clinical diagnosis
-
Legal advice
-
Emergency or crisis services
The Services do not establish a provider-patient, therapist-client, supervisor-supervisee, attorney-client, or other professional relationship between Pergola Crew Collective and a user, student, client, caregiver, or organization.
Information and materials generated through the Services must not replace:

Professional judgment

Direct assessment
-
Individualized clinical decision-making

Qualified supervision
-
Organizational review
-
Compliance with payer requirements
-
Compliance with professional ethics
-
Emergency assistance
Users remain fully responsible for every educational, behavioral, clinical, billing, documentation, supervision, and treatment decision.
In an emergency, contact appropriate emergency services or a qualified professional. Do not rely on the Services for emergency intervention.
4. Accounts and Access
Certain features require an approved account, subscription, trial invitation, access grant, or magic link. You are responsible for:

Keeping login credentials and access links confidential

Protecting access to your email account

Signing out of shared devices

Maintaining accurate account information

Restricting account access to authorized users
-
Notifying us promptly of suspected unauthorized use
You may not:

Share an individual account with unauthorized users

Transfer or sell an account or trial link

Use another person’s account without permission

Reuse another tester’s magic link

Circumvent product-access restrictions
-
Attempt to gain access to products not included in your trial or subscription

Interfere with login, authentication, or security controls
Access may be assigned by product. Access to Skill Bridge does not automatically include Beacon ABA, and access to Beacon ABA does not automatically include Skill Bridge. We may suspend or revoke access when we reasonably believe an account, token, invitation, or access link has been shared, misused, compromised, or used in violation of these Terms.
5. Trials, Testers, and Preview Features
We may offer free trials, pilot programs, tester accounts, preview environments, demonstrations, early-access features, or promotional access. Trial and tester access may:

Be limited to specific users or organizations

Apply only to selected products

Expire after a stated period

Require manual approval
-
Use individualized magic links
-
Contain incomplete or experimental features
-
Be modified or discontinued at any time
Unless we expressly disclose otherwise during enrollment, a free trial will not automatically convert into a paid subscription without the user selecting or authorizing a paid plan. Testers may be asked to provide feedback, report errors, or evaluate features. We do not guarantee that tester data or materials will remain available after the trial ends. Preview and early-access features may be unstable, incomplete, unavailable, or materially changed before general release.
6. Organization and Clinic Accounts
Schools, clinics, businesses, and other organizations may purchase or receive access for multiple users. The organization is responsible for:

Selecting authorized personnel

Assigning appropriate permissions

Removing users who no longer require access
-
Ensuring that account use complies with its policies
-
Providing required training and supervision
-
Determining what information personnel may enter
-
Maintaining required consent, authorization, and documentation

Reviewing generated content before use
An organization administrator may be able to manage users, subscriptions, permissions, or materials associated with the organization’s account. Users accessing the Services through an organization understand that the organization may control their access and may have rights concerning information created under its account.
7. User Content
“User Content” means information or materials that users enter, create, upload, submit, store, or generate through the Services. User Content may include:

Names, initials, or identifiers

Visual supports

Schedules and routines

Goals and objectives
-
Notes and observations
-
Session documentation
-
Educational materials
-
Client or student information
-
Images and documents

Treatment-plan drafts

Prompts submitted to AI-assisted tools

Generated materials edited or saved by the user

Feedback and communications
You retain your ownership rights in your User Content. You grant Pergola Crew Collective a limited, nonexclusive, worldwide, royalty-free license to host, store, process, reproduce, display, transmit, and otherwise use User Content only as reasonably necessary to:

Operate the Services

Generate requested outputs

Provide support

Maintain security
-
Prevent misuse

Troubleshoot errors

Fulfill contractual obligations

Improve platform functionality using aggregated or deidentified information
This license ends when the content is deleted from active systems, subject to reasonable backup, legal, security, and retention requirements. You represent that:

You have the right and authority to submit the User Content.

You have obtained any required consent or authorization.

The content does not violate privacy, confidentiality, intellectual-property, or other legal rights.
-
Your submission complies with professional, employer, school, clinic, payer, and organizational requirements.
8. Responsibility for Client, Student, and Child Information
Users may enter information relating to students, children, clients, patients, caregivers, staff members, or other individuals. You are solely responsible for determining:

Whether you are authorized to enter that information

Whether consent is required

Whether the information should be deidentified
-
Whether your employer or organization permits its use
-
Whether the applicable Service is approved for the information
-
Whether applicable education, health, privacy, and professional rules have been satisfied
Use the minimum information reasonably necessary for the intended purpose. Do not enter highly sensitive information that is unnecessary for using the Services, including Social Security numbers, financial-account credentials, or complete medical records.
9. HIPAA and Protected Health Information
Use of an ABA-related tool does not by itself mean that Pergola Crew Collective or every feature of the Services is HIPAA-compliant.
Unless Pergola Crew Collective and the applicable organization have entered into a written Business Associate Agreement covering the relevant Service, users must not assume that the Service is authorized to receive, maintain, or transmit protected health information. Users and organizations are responsible for determining whether:

HIPAA applies to their use

A Business Associate Agreement is required

A particular feature has been approved for protected health information
-
Additional safeguards, agreements, permissions, or configurations are necessary
A general statement about privacy or security does not replace a Business Associate Agreement.
10. AI-Assisted Features
The Services may use artificial intelligence to generate, revise, organize, summarize, suggest, or format content. AI-generated content may:

Contain factual errors

Misinterpret user input

Omit important information
-
Produce inappropriate recommendations

Include language that does not satisfy payer or professional standards

Be inconsistent across multiple requests

Require substantial correction
-
Be unsuitable for a particular client, student, organization, or situation
You must independently review, edit, and approve all AI-generated output before using, saving, submitting, billing, publishing, or relying on it. You may not represent that content was independently assessed or clinically approved merely because it was generated through the Services. Users remain responsible for:

Documentation accuracy

Medical necessity
-
Goal selection
-
Treatment decisions

Billing-code selection

Payer compliance

Professional ethics

Required signatures and attestations

Avoiding fabrication or false documentation
We do not guarantee that generated notes, goals, treatment plans, schedules, activities, or recommendations will meet any payer, licensing board, accreditation organization, school district, employer, or regulatory requirement.
11. Prohibited Uses
You may not use the Services to:

Violate any law or regulation

Violate professional or ethical requirements

Create false, misleading, fraudulent, or fabricated records

Submit documentation for services that were not provided

Misrepresent AI-generated content as independently observed facts
-
Harass, exploit, abuse, threaten, or harm another person

Upload unlawful, defamatory, infringing, or malicious material
-
Introduce viruses, malware, or harmful code
-
Probe, scan, or test platform vulnerabilities without permission

Bypass authentication or access controls
-
Access another user’s information without authorization
-
Scrape, crawl, harvest, or extract data through unauthorized automated means
-
Copy, clone, reverse engineer, or recreate the Services except as permitted by law
-
Resell access without written authorization
-
Use the Services to develop a substantially competing product through systematic copying
-
Overload, disrupt, or interfere with platform operation
-
Remove copyright, trademark, or proprietary notices
We may investigate suspected misuse and suspend or terminate access where reasonably necessary.
12. Templates and Generated Materials
The Services may provide templates, images, activity formats, icons, wording suggestions, or generated materials. Subject to these Terms and any stated license restrictions, users may generally use materials they lawfully create through their accounts for their own:

Unless a plan or written license expressly permits it, users may not:

Resell our templates as standalone products

Copy the design or functionality of the platform

Publish shared account credentials or magic links
Materials incorporating third-party images, fonts, icons, or other assets remain subject to applicable third-party rights and restrictions.

Pergola Crew Collective and its licensors own all rights in the Services, including:

Selection and arrangement of materials
These materials are protected by copyright, trademark, trade-secret, and other intellectual-property laws. Except for the limited right to use the Services under these Terms, no ownership rights are transferred to you. “Pergola Crew Collective,” “Skill Bridge,” “Beacon ABA,” their logos, and related branding may not be used without written permission.
14. Feedback
You may provide ideas, comments, suggestions, feature requests, corrections, or other feedback. By submitting feedback, you grant us the right to use, modify, develop, commercialize, and incorporate it without restriction, attribution, payment, or other obligation. This does not transfer ownership of unrelated User Content.
15. Subscriptions and Billing
Some Services may require a paid subscription.
A. Pricing
Prices, included features, account limits, and billing periods will be displayed when you select a plan. Taxes may be added where required.
B. Payment Authorization
By purchasing a subscription, you authorize us and our payment processors to charge the selected payment method for applicable fees, taxes, renewals, and authorized purchases.
C. Automatic Renewal
When a plan is identified as automatically renewing, it will renew at the applicable interval until canceled. You are responsible for canceling before the renewal date to avoid the next charge.
D. Cancellation
You may cancel through the available account, billing, or subscription-management controls, or by contacting us when self-service cancellation is unavailable. Cancellation generally prevents future renewal. It does not ordinarily terminate access immediately; access may continue through the end of the paid billing period.
E. Refunds
Except where required by law or expressly stated in a written offer, payments are nonrefundable after they are charged. We may evaluate billing errors or exceptional refund requests individually, but doing so does not create an obligation to approve future requests.
F. Failed Payments
If payment fails, we may:

G. Price and Plan Changes
We may change prices, features, limits, or plan structures. For existing recurring subscribers, material changes will take effect after any notice required by law or the applicable billing arrangement. Continued use after a change takes effect constitutes acceptance of the revised price or plan.

19. Service Availability and Changes
We aim to provide reliable Services, but we do not guarantee uninterrupted availability. The Services may be unavailable because of:

20. Data Export and Account Closure
Where export tools are available, users are responsible for exporting materials they wish to retain before access ends. Following expiration, cancellation, suspension, or termination:

We are not responsible for a user’s failure to export materials before account access ends.

22. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PERGOLA CREW COLLECTIVE AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AFFILIATES, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING:

These limitations apply regardless of the legal theory asserted and even if we were advised that damages were possible. Some jurisdictions do not permit certain limitations, so portions of this section may not apply.
23. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Pergola Crew Collective and its owners, officers, employees, contractors, affiliates, licensors, and service providers from claims, liabilities, losses, damages, judgments, penalties, costs, and reasonable legal fees arising from:

24. Suspension and Termination
You may stop using the Services at any time. We may limit, suspend, or terminate access when:

Where appropriate, we may provide notice or an opportunity to correct a violation. We may act immediately when necessary to protect users, data, systems, or legal rights. Provisions that by their nature should survive termination will remain effective, including provisions concerning intellectual property, payment obligations, disclaimers, liability, indemnification, dispute resolution, and governing law.
25. Governing Law
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles.
26. Dispute Resolution and Venue
Before filing a legal claim, you agree to contact us and make a reasonable good-faith effort to resolve the dispute informally. Unless applicable law requires otherwise, any lawsuit arising from or relating to these Terms or the Services must be brought in a state or federal court with jurisdiction in Orange County, Florida. You consent to the personal jurisdiction and venue of those courts.
27. Changes to These Terms
We may update these Terms periodically. When changes are made, we will update the “Last Updated” date. For material changes, we may provide additional notice through the website, Services, or email. Changes generally apply prospectively when posted or on the effective date stated in the notice. Continued use of the Services after revised Terms become effective constitutes acceptance of the updated Terms.
28. Assignment
You may not assign or transfer your rights or obligations under these Terms without our written permission. We may assign these Terms as part of a merger, acquisition, financing, restructuring, sale of assets, corporate reorganization, or transfer of the Services.
29. Severability
If any provision of these Terms is found invalid, unlawful, or unenforceable, that provision will be enforced to the greatest extent permitted, and the remaining provisions will continue in effect.
30. No Waiver
Failure to enforce a provision of these Terms does not waive our right to enforce it later. A waiver is effective only if it is made in writing by an authorized representative of Pergola Crew Collective.
31. Entire Agreement
These Terms, the Privacy Policy, applicable order forms, subscription details, and any signed agreements constitute the entire agreement concerning the Services and replace prior discussions or representations concerning the same subject. If a signed written agreement conflicts with these Terms, the signed agreement controls to the extent of the conflict.
